Privacy Policy

BuildClear, Inc. ("BuildClear," "we," "us," or "our") is a Delaware corporation operating in California.
1. Introduction
This Privacy Policy explains how BuildClear collects, uses, shares and protects personal information when you use the BuildClear app and its email and text services, or visit buildclear.ai.
2. Information We Collect
Account Data
When you create an account or are invited to a project, we collect your name, email address, phone number, company name, and role within the organization.
Project Data
BuildClear processes construction project information uploaded by you or your organization, including documents, plans, specifications, requests for information (RFIs), submittals, contracts, cost data, and schedules.
Communications Data
We collect the emails sent or copied to BuildClear addresses and the text messages sent or forwarded to BuildClear, and add them to the project record.
Usage Data
We automatically collect information about how you use BuildClear, including the pages you view, your clicks and scrolling, whether you open the emails we send, your device and browser type, operating system and IP address. Our service providers collect it for us, including to find and fix errors.
Cookies and Tracking Technologies
We use cookies to sign you in, keep your session and remember your settings. We don't use third-party advertising cookies, and we don't allow third parties to track your activity across other websites through BuildClear.
We don't respond to Do Not Track signals, because there is no common standard for them.
Website Chat and Early Access Requests
The Sparky chat on buildclear.ai can send each message you type to our servers, where a third-party AI model provider reads it so the chat can answer. We don't store your chat messages. When you send the early access card at the end of the chat, we collect what it shows: your email address, your name, your company if you give one, your role, your project type, your project's phase, the kind of problem you picked and, if you leave it on the card, what you wrote about it. The early access form on our site collects your email address, your name and your company and, if you give it, your role. Both also record any campaign tags in the page's web address when you send them.
Bot Protection
We may use Cloudflare Turnstile to protect the forms and chat on buildclear.ai from bots. When we do, Cloudflare processes limited information about your device and browser for that purpose, as described in Cloudflare's Turnstile Privacy Addendum.
3. How We Use Your Information
We use the information we collect to:
- Provide and operate BuildClear, including processing your documents, emails and texts with AI features
- Send project notifications and alerts by email and text
- Reply to requests for early access and understand who is asking for it
- Maintain, secure and improve our services
- Create de-identified, aggregated data, which we keep in that form and don't try to re-identify
- Comply with the law and protect our rights
4. AI Processing
BuildClear's AI features extract, classify, summarize and analyze the documents, emails and texts in your projects. They're powered by third-party AI model providers. We send the documents, emails and texts in your projects to those providers to process on our behalf.
Their terms say they do not train their models on data sent through their APIs. Signing out in Settings clears your AI consent on this device, but BuildClear keeps processing the project mail and texts you're on. If you delete your account, messages already in a project stay in its record and BuildClear keeps processing them for that project.
5. How We Share Your Information
We do not sell your personal information or share it for advertising. We disclose it only to service providers that process it on our behalf to run BuildClear: cloud hosting and storage, AI model providers, email and text message delivery, push notifications, maps and address lookup, payment processing, and error and performance monitoring. These providers are bound by written agreements to protect it as this policy describes.
We may also disclose your information if required to do so by law, court order, subpoena, or government request.
If we're involved in a merger, acquisition, reorganization or sale of assets, your information may be transferred as part of that transaction.
6. SMS and Mobile Data
We do not sell or share mobile or personal data with third parties, affiliates, or partners for marketing or promotional purposes.
We only share data with third parties when it is strictly necessary to deliver our service and only under binding agreements that ensure confidentiality.
Under no circumstances will mobile data be shared or sold for advertising or promotional use.
Message frequency varies based on project activity and your notification preferences. Message and data rates may apply.
To opt out of SMS notifications, reply STOP to any message from BuildClear. For assistance, reply HELP or contact us at support@buildclear.ai.
We do not share your opt-in consent status with any third parties. Consent to receive text messages is not a condition of purchasing or using the Service.
7. Data Security
We use commercially reasonable technical, administrative and organizational measures designed to protect your information from loss, misuse and unauthorized access, disclosure, alteration or destruction.
No method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.
8. Data Retention
We keep personal information for as long as we need it to provide the services, comply with the law, resolve disputes and enforce our agreements. For 30 days after an account ends you can ask us for a copy of your data. After that we may delete it. You can delete your account in the app or by emailing support@buildclear.ai.
9. California Privacy Rights (CCPA/CPRA)
If you're a California resident, the California Consumer Privacy Act (CCPA) gives you the right to know what personal information we collect, use and disclose, to ask us to delete or correct it, and to not be treated differently for using these rights. We don't sell personal information or share it for cross-context behavioral advertising. To make a request, email privacy@buildclear.ai. You can also use an authorized agent. We may need to verify your identity, and we'll respond within the time the law allows.
Categories of Personal Information Collected
In the preceding 12 months, we have collected the following categories of personal information as defined by the CCPA:
- Identifiers: name, email address, phone number, IP address, account credentials
- Commercial information: project records, contracts, cost data, transaction history
- Internet or electronic network activity: browsing history on buildclear.ai, feature usage data, session information
- Professional or employment-related information: company name, job title, role within the organization
- Geolocation data: approximate location derived from IP address
- Communications content: emails and text messages sent to BuildClear
10. Additional State Privacy Rights
Residents of Virginia, Colorado, Connecticut and other states with privacy laws have similar rights to access, correct and delete their personal data. To use them, email privacy@buildclear.ai. If we decline a request, you may appeal by emailing the same address.
11. Children's Privacy
BuildClear is for construction professionals and isn't directed to children. We don't knowingly collect personal information from anyone under 16. If you think a child has given us personal information, email privacy@buildclear.ai and we'll investigate and, if appropriate, delete it.
12. Changes to This Policy
We may update this policy. We'll post the new version here with a new effective date and tell you about material changes as the law requires.
